这是现在分词做独立成分的现象.像generally speaking一般来说,Judging from/by 由……判断出,它们在句中属于独立成分,和句子的主语没有关系,一般可以认为动作发出者是作者或大众一般视角.
所以说这里做出判断的不是he,而是写作者.
